1. Introduction and Acceptance of Terms

These Terms and Conditions (hereinafter referred to as the "Agreement" or "Terms") dictate the legally binding rules governing your access to and use of all services made available directly or indirectly by Top Notch Trip. This includes our website (topnotchtrip.com), mobile applications, email communications, telephone services, and any other associated platforms (collectively referred to as the "Platform").

By accessing, browsing, registering an account, completing a reservation, or otherwise utilizing the Platform, you explicitly acknowledge, represent, and warrant that you have read, thoroughly understood, and unequivocally agreed to be bound by the stipulations contained within this Agreement. If you do not agree with any part of these Terms, you must immediately cease all use of the Platform.

Top Notch Trip reserves the right, at its sole discretion, to modify, amend, or update these Terms at any time without prior specific notice. Your continued use of the Platform following any such modifications constitutes your acceptance of the newly amended Terms.

2. Eligibility and Age Requirements

The Platform and its corresponding services are strictly intended for individuals who possess the legal capacity to enter into binding contracts. By utilizing this Platform, you represent and warrant that you are a minimum of eighteen (18) years of age. You further affirm that you possess the legal authority to create a binding legal obligation under applicable law. Unauthorized use by minors is expressly prohibited.

3. Nature of Services and Intermediary Status

Top Notch Trip operates exclusively as a ticketing aggregator and intermediary platform. We connect you with independent third-party service providers, including but not limited to bus operators, airlines, hotel management, car rental agencies, and entertainment companies.

Once a partnered service provider has enabled online access, Top Notch Trip facilitates the transaction and securely transmits e-tickets to you via SMS and/or email. Top Notch Trip does not own, operate, or directly control these third-party services. Consequently, Top Notch Trip shall not be held liable or responsible for any delays, rescheduling, operational failures, or booking cancellations initiated by the underlying service provider.

4. Payment Methods and Financial Transactions

Top Notch Trip is committed to providing a secure and seamless checkout experience. We currently support the following officially recognized payment methods:

• Credit and Debit Cards (MasterCard, Visa, American Express, Discover)

• Stripe Payment Gateway

• PayPal

• Apple Pay

• Google Pay

• Bank Transfers and Automated Clearing House (ACH) transactions

Anti-Fraud Measures: To comply with federal and state financial regulations and to prevent fraudulent activity, Top Notch Trip reserves the right to request identity verification. This may include requesting government-issued photo identification and masked images of the physical payment card used for a transaction before finalizing a booking.

5. Saved Cards, Tokenization, and Billing Authorization

To expedite future bookings, customers may opt to securely save their payment methods on the Platform.

Data Security: Top Notch Trip strictly adheres to Payment Card Industry Data Security Standards (PCI-DSS). We do not store your full, raw credit card details on our local servers. Instead, a securely encrypted digital token is generated and vaulted by our PCI-DSS compliant third-party payment processing partners.

Customer Consent and Liability: By electing to save a card and completing a transaction using this tokenized method, you expressly confirm and agree to the following conditions:

• You are the legal owner of the card or have explicit, documented authorization to use it.

• You grant continuous consent for future, seamless billing utilizing the saved token for purchases you initiate.

• All payments executed via the saved card are deemed intentional, authorized, and authenticated by you.

• You strictly agree not to initiate unwarranted chargebacks or disputes with your bank or card network for authorized transactions processed via the saved token.

Top Notch Trip maintains a zero-tolerance policy for friendly fraud. Any transaction disputed as fraudulent where the authorized saved token was successfully authenticated will be fiercely contested by Top Notch Trip, and we will not accept such claims as valid chargeback requests.

6. Permitted Use and Prohibited Conduct

The Platform, including all underlying architecture, content, and data, is provided solely for your personal, non-commercial use. All materials are heavily protected by domestic and international copyright, trademark, and intellectual property laws.

You expressly agree that you will not engage in any of the following prohibited activities:

• Duplicating, downloading, reproducing, or commercially exploiting any material, data, or digital products from the Platform.

• Utilizing automated scripts, spiders, scrapers, or bots to harvest data, inventory, or pricing information.

• Modifying, reverse-engineering, or attempting to compromise the security of the Platform.

• Reselling tickets, reservations, or subscriptions acquired through Top Notch Trip.

• Engaging in any activity that imposes an unreasonable load on our infrastructure.

Unauthorized access or distribution of Platform content is explicitly prohibited and will result in immediate account termination and aggressive legal action.

7. Subscriptions: Top Notch Plus

Users may opt into our premium subscription service, Top Notch Plus. The following rules govern this program:

• Auto-Renewal: Your subscription is programmed to automatically renew at the conclusion of each billing cycle unless you proactively initiate a cancellation.

• Non-Refundable Policy: All subscription fees are strictly non-refundable once charged. Cancellations will only prevent charges for the subsequent billing cycle.

• Fee Adjustments: Top Notch Trip retains the right to alter subscription pricing at any time. Active subscribers will receive prior written notification before new rates take effect.

• Termination Rights: We reserve the right to suspend or permanently terminate your subscription privileges at any time, without refund, should we determine you have violated these Terms.

• Modifications: Top Notch Trip may update the benefits or terms of the Top Notch Plus program at its sole discretion.

8. Offers, Rewards, Contests, and Lucky Draws

From time to time, Top Notch Trip may host promotional events. The following baseline rules apply unless explicitly stated otherwise in the specific promotion's rules:

• Promotion Window: Only verified purchases completed during the officially stated Promotion Period are eligible for entry.

• Winner Notification: Winners will be contacted exclusively via the email address or phone number provided during the purchase process.

• Forfeiture Clause: If Top Notch Trip cannot successfully reach a winner within three (3) working days of the initial attempt, the prize is immediately forfeited. Alternative prizes or extensions will not be offered.

• Prize Conditions: All rewards and prizes are strictly non-refundable, non-exchangeable, non-transferable, and cannot be redeemed for cash equivalents.

• Exclusion of Liability: Top Notch Trip assumes no responsibility for entries, notifications, or communications that are lost, delayed, or damaged due to technical failures or user error.

9. Disclaimers, Indemnification, and Limitation of Liability

Disclaimer of Warranties: The Top Notch Trip Platform, including all content, software, functions, and third-party services, is provided on a strict "AS IS" and "AS AVAILABLE" basis. Top Notch Trip makes no representations or warranties of any kind, express or implied, regarding the uninterrupted operation of the Platform or the absolute accuracy of the information provided.

Limitation of Liability: To the maximum extent permitted by law, Top Notch Trip, its officers, directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising out of your access to, or inability to access, the Platform, or the failure of any third-party service provider to fulfill their obligations.

Indemnification: You agree to rigorously defend, indemnify, and hold harmless Top Notch Trip and its affiliates from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs arising from your breach of these Terms, your violation of any law, or your misuse of the Platform.

10. Dispute Resolution and Governing Law

Jurisdiction: This Agreement shall be governed by, and construed strictly in accordance with, the laws of the State in which Top Notch Trip is incorporated and legally headquartered within the United States, disregarding its conflict of law provisions.

Arbitration and Class Action Waiver: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be resolved by mandatory, binding arbitration rather than in a court of general jurisdiction. Furthermore, all proceedings to resolve disputes will be conducted strictly on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action.
